Condition of Unit Please be advised that ALL units are sold As-Is, Where-Is unless specified in writing and signed. These units are all USED, Pre-OWNED and otherwise NOT NEW. Therefore they carry no warranty from Byrne Equipment Sales unless stated in writing and signed, on sale documents. Occasionally on newer items, there may be the remainder of factory warranty still active. It will be the responsibility of the BUYER to confirm and detail any such warranty and conditions.
Byrne Equipment Sales warrants that all items are transferred to the Buyer free and clear of any liens and encumbrances.
These are used /pre owned items. We do our very best to give accurate descriptions of all items, however no two people have the exact same opinion. Therefore, all units are freely available for inspection and we ENCOURAGE all interested parties to fully inspect the unit personally or have the unit inspected by an independent source so you are confident in knowing exactly what you are getting for your particular USE and PURPOSE.
Payment No unit will be released to the BUYER or for Transport until payment has been made IN FULL and ALL funds have cleared our accounts. This applies to Personal Checks, Business Checks, Money Orders, Cashiers Checks , Bank Certified Checks, Bank Drafts etc. ALL of which can take up to 10 business days (or longer) to clear. The fastest form of payment is a Wire Transfer, which will GENERALLY clear within a few hours if made in the morning on a regular Bank business day (Mon-Fri). If you are needing to make a purchase fast and plan to come inspect, make arrangements with your bank PRIOR to arrival in Craig to make a wire transfer personally via phone, fax or other remote option, or have someone available to go directly to your bank and do the wire in person. WE may make exceptions to the payment policy for LOCAL buyers.
Any Cash Payments over $10,000 (in part or in whole for a transaction) will require that IRS Form 8300 (“Report of Cash Payment Received in Trade or Business”) be filled out and filed. This applies to a total amount paid for one item, whether paid all at one time or in installments or part cash and other form of payment which in total amount to $10,000 or more.
If it becomes necessary for Byrne Equipment Sales to enforce the Dealers’ rights under federal, state or local law, Buyer will pay all costs, whether or not a suit or action is filed. Any action will take place in Colorado, and the laws of the State of Colorado will apply.
If you plan to purchase/remove a unit on Friday or Saturday, please make sure you have ALL payments verified PRIOR. Your purchase WILL NOT be released until the following week, during regular business days when funds can be confirmed and cleared.
